Terms of Service

These Terms and Conditions ("Terms") govern your access to and use of MarketMyWebsite.com and any related websites, apps, products, services, and APIs (collectively, the "Service") provided by Riviera 4 Media, Inc. ("MarketMyWebsite," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms.

1) Eligibility and Account Responsibility

You must be at least 18 years old (or the age of majority where you live). You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

2) Service Description; Suggestions Are Not Advice

The Service provides analytics, diagnostics, insights, recommendations, and suggested improvements related to websites, tracking, SEO, and marketing performance ("Suggestions"). Suggestions may be generated using automated systems, including AI.

Suggestions are informational only and are not legal, financial, security, tax, or professional advice. Suggestions may be incomplete, inaccurate, or not applicable to your specific website, tech stack, business constraints, or legal obligations.

You are solely responsible for:

  • deciding whether to implement any Suggestion,

  • validating and testing changes safely (including backups and rollback plans),

  • ensuring compliance with applicable laws and regulations (including privacy and consent laws),

  • ensuring compliance with third-party platform policies (including ad and analytics platform terms),

  • and the results of any changes you make.

3) Integrations (GA, GSC, Ad Accounts) and Your Authorization

If you connect third-party accounts (including Google Analytics, Google Search Console, Google Ads, Meta Ads, or other advertising/marketing platforms), you authorize us to access, process, and display the data you permit through those integrations to provide the Service.

You represent and warrant that you have the authority to connect those accounts and to grant us access to the associated data.

Third-party services are governed by their own terms and policies. We are not responsible for third-party availability, actions, security, or data handling.

4) Acceptable Use

You agree not to:

  • access or use the Service for unlawful purposes;

  • interfere with or disrupt the Service or its security;

  • attempt to gain unauthorized access to accounts, systems, or networks;

  • upload or transmit malware;

  • scrape, crawl, or extract data from the Service in a way that materially burdens the Service or violates these Terms;

  • reverse engineer the Service except to the extent prohibited by law.

5) Fees, Billing, and Payments (Stripe)

If you purchase a subscription or paid plan:

  • pricing, billing cadence, and plan details are presented at checkout and/or in your account;

  • payments are processed by Stripe (or another processor we designate);

  • unless required by law or explicitly stated in writing, fees are non-refundable and we do not provide prorated refunds for partial billing periods.

6) Cookie Banner and Consent Mode

The Service uses cookies and similar technologies for authentication, security, preferences, and measurement. Where required, we display a cookie banner and use consent mode to respect your choices. Some features may not function correctly if cookies are declined or disabled.

7) Intellectual Property

We own and retain all rights in the Service, including its software, design, and content (excluding your User Data). Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes during your authorized use.

8) User Data

You may provide or connect data such as website URLs, tracking configurations, event schemas, analytics outputs, and ad performance data ("User Data"). You grant us a limited license to host, process, transmit, and display User Data as necessary to provide, maintain, and improve the Service, and as described in our Privacy Policy.

You represent and warrant that your User Data and your use of the Service comply with applicable laws and do not infringe or violate third-party rights.

9) AI and Product Improvement; Opt-Out

We may use certain information related to your use of the Service (including inputs, outputs, feedback, and usage patterns) to maintain and improve the Service, including automated and AI-driven features.

Opt-out: You may opt out of having your data used for AI training/improvement purposes by emailing legal@marketmywebsite.com from the email address associated with your account. After opt-out is processed, we will stop using your data for those purposes going forward, subject to limited exceptions (e.g., security, fraud prevention, legal compliance, and maintaining essential service functionality).

10) Disclaimers (No Warranties)

THE SERVICE (INCLUDING SUGGESTIONS) IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that Suggestions will improve rankings, performance, conversions, revenue, compliance posture, or measurement accuracy.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • IN NO EVENT WILL MARKETMYWEBSITE OR RIVIERA 4 MEDIA, INC., OR ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES ARISING OUT OF OR RELATING TO THE SERVICE OR ANY SUGGESTIONS, EVEN IF ADVISED OF THE POSSIBILITY.

  • OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) $100.

Some jurisdictions do not allow certain limitations. In those jurisdictions, liability will be limited to the maximum extent permitted by law.

12) Indemnification

You agree to defend, indemnify, and hold harmless Riviera 4 Media, Inc. and its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising from or relating to:

  • your use of the Service;

  • your implementation (or failure to implement) any Suggestions;

  • your User Data;

  • your violation of law or third-party rights; or

  • your breach of these Terms.

13) Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, create risk to the Service or others, or as reasonably necessary to protect the Service.

14) Changes to the Terms or Service

We may update these Terms from time to time. We'll update the "Last Updated" date and provide notice of material changes where required by law. Continued use after changes become effective constitutes acceptance.

15) Governing Law and Venue

These Terms are governed by the laws of the State of California, excluding conflict of laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction and venue in those courts.
